• Ensure that your use of our automation tools complies with all applicable laws, including anti-spam regulations (e.g., TRAI regulations in India).
• Maintain the confidentiality of any account credentials provided to you.

4. Use of AI, Automation & Third-Party Tools

Our services rely on various third-party platforms and technologies, including but not limited to WhatsApp (Meta), OpenAI, Anthropic, Twilio, and other telecom or cloud providers.

• Platform Dependency: We are not responsible for service interruptions, policy changes, or bans imposed by third-party platforms (e.g., WhatsApp blocking a number due to policy violations).
• AI Limitations: AI voice agents and chatbots may occasionally generate incorrect or "hallucinated" responses. We do not guarantee 100% accuracy in AI-generated content.
• Compliance: It is your responsibility to ensure your use of these tools aligns with the terms of service of the respective third-party providers.

5. Payment, Pricing & Subscriptions

Pricing for our services varies based on the scope of the project, usage volume, and specific requirements.

• Quotes: Specific fees will be outlined in your custom proposal or invoice.
• Payment Terms: Invoices are due upon receipt unless otherwise specified in your agreement.
• Changes: We reserve the right to modify our pricing for future services or renewals with prior notice.

6. Intellectual Property Rights

Unless otherwise agreed in writing:

• Our IP: Levanta Automation retains ownership of our pre-existing codebases, proprietary implementation methods, and internal tools used to deliver the service.
• Your IP: You retain full ownership of your business data, customer lists, and specific content provided to us for training the AI models.

7. Service Limitations & Disclaimer

No Guarantee of Results: While we strive to deliver high-quality business automation solutions, we do not guarantee specific business outcomes, such as a set number of leads, sales conversions, or revenue increases. Market conditions and customer behavior are beyond our control.

"As Is" Basis: Our services and website are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied.

8. Limitation of Liability

To the fullest extent permitted by law, Levanta Automation shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business reputation, arising out of or in connection with your use of our services or reliance on AI automation services.

9. Termination of Services

We reserve the right to suspend or terminate your access to our services at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason. You may terminate your service agreement with us by providing notice as specified in your contract.

10. Third-Party Links & Integrations

Our website and services may contain links to third-party web sites or services that are not owned or controlled by Levanta Automation. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

11. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in India.

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. Your continued use of the service following the posting of any changes constitutes acceptance of those changes.
